On January 21, the Government presented a bill on environmental crimes, which seeks to be a preventive and dissuasive instrument for conducts that cause serious damage to the environment, thus complementing current regulations on environmental matters.
Among other aspects, the project proposes to strengthen the role of the Superintendency of the Environment (SMA) and promote the application of control and prevention models of this type of crime within companies, but also establishes fines, which range from $ 24 , 2 million to $ 48.3 million, and jail terms, from 61 days to 5 years, to people and companies who incur in these acts.
In addition, the bill defines two new crimes that were not classified: obstruction of the SMA's inspection and the delivery of false information to the inspection body.
